1.2. Buyer
il Buyer is il consumer who places an order through storks.com.tr e whose name, surname or company name, Contatti details, billing information e consegna information are collected electronically during il ordering process. il Buyer’s information is provided in il order summary e Preliminary Information Form.
2. Subject e Legal Basis di il Agreement
il purpose di this Agreement is to establish il rights e obligations di il parties concerning il sale e consegna di il product ordered electronically by il Buyer through storks.com.tr.
This Agreement has been prepared in accordance con Consumer Protection Law No. 6502, il Distance Contracts Regulation e other applicable legislation.
3. Preliminary Information e Formation di il Agreement
Before confirming il order, il Buyer is informed through il Preliminary Information Form e order summary about il product’s essential characteristics, il Seller’s details, il total prezzo inclusive di all taxes, any consegna e additional charges, payment e consegna conditions, il right di withdrawal, il return procedure e applicable exceptions.
il Agreement is concluded electronically when il Buyer confirms receipt di il Preliminary Information Form e expressly approves il order, which entails an obligation to pay.
il Preliminary Information Form, order summary, specifications stated on il product page e all expressly disclosed conditions di sale form an integral part di this Agreement.
4. Product, prezzo e Order Information
il order summary e Preliminary Information Form specify il type, modello e quantity di il product; il selected variant or misura; gemstone e precious-metal characteristics; certificato details; sales prezzo inclusive di all taxes; discounts; consegna charges; total amount payable; e payment method.
Product images may display slight colore variations due to differences in screens e lighting conditions. naturale gemstones may have unique variations in colore, tone, texture e naturale markings. il characteristics forming il basis di il sale are determined according to il product description, selected variant e certificato information supplied con il product.
5. Payment
il Buyer may select one di il available payment methods offered during checkout, including un credit or debit card, Bonifico bancario/EFT or another available method. Card e payment transactions are processed through il secure infrastructure di authorised banks or payment service providers.
If payment cannot be completed due to unauthorised use, security concerns, technical errors or rejection by il relevant bank or payment service provider, il order may not be processed. il Seller will inform il Buyer accordingly.
6. consegna
il product will be delivered to il consegna address e il person or organisation specified by il Buyer during checkout. il Buyer must provide accurate e complete consegna information.
Unless un shorter period is promised on il product page or in il Preliminary Information Form, products held Disponibile will be dispatched as soon as reasonably possible after il order has been confirmed by il Seller. in all circumstances, consegna will not exceed il statutory maximum period di 30 days. un different agreed consegna period may apply to products specially prepared at il Buyer’s request.
Unless otherwise stated during checkout, gioielli Ordini are sent by secure e assicurata consegna. If il package shows visible signs di damage or opening at il time di consegna, il Buyer is advised to ask il courier to prepare un damage report e to notify il Seller. Failure to obtain such un report does not remove il consumer’s statutory rights.
7. Impossibility di Performance
If it becomes impossible to fulfil il order per il relevant product or service, il Seller will notify il Buyer in writing or through un durable medium within three days di becoming aware di il situation.
All payments collected will be refunded within no altro than 14 days di il notification date, using un method compatible con il payment instrument used per il purchase e without imposing any costs on il consumer.
8. Right di Withdrawal
il Buyer may withdraw da this Agreement within 14 days di il date on which il product is delivered to il Buyer or un third party designated by il Buyer, without providing any reason e without incurring un penalty. il Buyer may also exercise il right di withdrawal between il date on which il Agreement is concluded e il date on which il product is delivered.
It is sufficient per il withdrawal notice to be sent to il Seller in writing or through un durable medium before il 14-day period expires.

il Buyer must return il product to il Seller or un person authorised by il Seller within 10 days di submitting il withdrawal notice. This obligation does not apply if il Seller offers to collect il product directly.
9. Returns e Refunds
un product returned under il right di withdrawal must not have been used beyond what is necessary per un reasonable inspection. Where possible, it should be returned con its original box, invoice, certificato e all accompanying items supplied con il product. Opening il packaging does not, by itself, invalidate il right di withdrawal.
il Buyer is not responsible per any change or deterioration occurring when il product is used during il withdrawal period in accordance con its operation, technical specifications e instructions per use. Any reduction in value caused by use exceeding what is necessary per un reasonable inspection may be assessed in accordance con applicable legislation.
Within 14 days di receiving il withdrawal notice, il Seller will refund all payments collected, including consegna costs where applicable. il refund will be issued in un single payment using un method compatible con il payment instrument originally used by il Buyer, without imposing any costs or obligations on il Buyer.
il Preliminary Information Form will clearly identify il designated return carrier e specify which party is responsible per il return costs. il Buyer will not be charged per return consegna when using il carrier designated by il Seller. If il designated carrier does not have un branch in il Buyer’s location, il Seller will arrange collezione di il product without requesting any additional payment.
10. Exceptions to il Right di Withdrawal
Under il Distance Contracts Regulation, il right di withdrawal cannot be exercised in relation to contracts per goods prepared according to il Buyer’s requests or personal requirements.
This exception may apply in particular to:
Products engraved or marked at il Buyer’s request con un name, initial, date, message or speciale symbol
Products specially manufactured per il Buyer or permanently altered in un manner differing da il standard sales options
Products manufactured outside il standard ready-made misura range at il Buyer’s request or individually resized after consegna
un product being discounted or included in un promotion or speciale-occasion campaign does not, by itself, remove il right di withdrawal. If an exception to il right di withdrawal applies, il Buyer will be clearly informed di il product’s personalised nature before placing il order.
11. Defective Products e il Consumer’s Optional Rights
If un product does not conform to il characteristics agreed under il Agreement, il Buyer may exercise one di il following rights, subject to il conditions parure out in Law No. 6502:

Request un free repair, provided that this would not result in disproportionate costs
Request replacement con un defect-free equivalent, where possible

12. Complaints e Dispute Resolution
il Buyer may submit requests e complaints relating to an order by emailing online@storks.com.tr or calling 0 (212) 526 10 10.
per consumer disputes arising da this Agreement, Consumer Arbitration Committees e Consumer Courts located in il Buyer’s place di residence or il place where il consumer transaction was concluded will have jurisdiction, subject to il monetary thresholds announced annually by il Ministry di Trade.
13. Protection di Personal Data
il Buyer’s personal data is processed in accordance con il KVKK Privacy Notice per il purposes di concluding e performing il order e fulfilling legal obligations. Consent to marketing is not un condition per entering into this Agreement.
14. Retention di Records e Evidence
il Seller will retain records relating to il transaction, preliminary information, order, payment, consegna, withdrawal e return per il period prescribed by applicable legislation.
il parties’ records may be used as evidence in il event di un dispute, provided that they have been created lawfully.
15. Entry into Force
This Agreement enters into force when il Buyer confirms receipt di il Preliminary Information Form e approves il order, which entails an obligation to pay.
un copy di il Agreement will be provided to il Buyer by email or another durable medium e retained in un manner accessible to il Buyer.
